CONSUMER PROTECTION LAWS
The consumer protection law in India is governed by the Consumer Protection Act, 1986 as amended in 2002 to protect the rights of the innocent consumer.
The Consumer Law has been amended with a view to circumscribe a wide range of services into its ambit. The essential ingredients to raise a consumer dispute before a consumer court requires that the complainant shall be satisfy the court to be a consumer as defined in the Act.
As per the Act a consumer is a person who buys any goods or hires any services for a consideration and includes any user of such goods or services other than the person who buys such goods or avail such services when such use is made with the approval of such person. A person disqualifies to be a consumer who obtains such goods for resale or for any commercial purpose.
A consumer complaint can be filed in the appropriate forum for any dispute regarding the deficient service availed or defective goods received or any unfair trade practices by the dealer/manufacturer of goods or the service provider.
The Courts/ Forum for Consumer disputes Redressal are three tiers in India:
- District Consumer Disputes Redressal Forum (functioning at district level)
- State Consumer Disputes Redressal Commission (functioning at state level)
- National Consumer Disputes Redressal Commission(functioning at national level)
All the above mentioned Consumer forums have their own territorial jurisdiction and pecuniary jurisdiction as well.
